A judge in Montana has handed down a 60-day sentence for the repeated rape of a 12 year old girl. In Montana this man pled guilty to this offense and did what is considered a “lid” or an open plea. There was a maximum or around 25-30 years but the judge could sentence him to anything below that proposed sentence. The judge handed down a 30 year stayed sentence, which means if the individual violates on probation he could do the 30 year term. With credit for time served in this case, its likely the offender will do just around 40 days.

Public Outraged at Montana Judge

The public and multiple different websites are outraged by the judge’s decision. The judge pointed to the fact that this individual needed help and that a psychologist noted that he could be helped with classes that could make him better. It is standard in most states to impose classes for any type of sexual assault crime. The problem is, these classes are generally one year long and one hour a day. This is crazy thing to think of when considering that this individual raped a child.

The general public has wanted this judge to be recalled much like the judge in the infamous Brock Turner case that was in California. After a ton of political pressure that judge agreed to no longer hear criminal cases. Judge McKeon noted that he thought it was a fair and reasonable verdict but I don’t think either the prosecutors or the judge thought that.

Statutory Rape Cases in California

Statutory rape cases in California hold some very hard penalties, which can be up to life in prison. They also require lifetime registration as a sex offender, and a long term of Parole when the prison term has finished. These are very serious cases no matter what state one is in.

Experienced San Diego Criminal Lawyers Can Help

In this case this individual was guilty and pled guilty to the offense. Unfortunately these types of things happen when the accused is actually innocent. The worst fear someone can have is being accused of a crime that they did not commit. It is a feeling of helplessness and a disbelief in the justice system. If you are ever accused of a crime you did not commit, make sure you hire someone that can help your case and can be there for you in your time of need.
